Kemelut perlantikan Imam Masjid Lenggeng sejak awal tahun ini semakin parah apabila 10 daripada 11 Ahli Jawatankuasa (AJK) masjid tersebut membuat laporan polis di Balai Polis Lenggeng pagi ini.
Dalam laporan polis tersebut Mohd Fahmy Mohd Tamin, 70, yang mewakili AJK masjid; lima Datuk-Datuk Adat Lenggeng (pemimpin setempat mengikut hirarki sistem Adat Perpatih Negeri Sembilan) dan 220 ahli kariah masjid; mendakwa salah laku tiga individu di dalam Jawatankuasa masjid tersebut menyebabkan urus tadbir Masjid Lenggeng menjadi celaru dan kucar kacir sejak awal tahun ini.
“Nazir Masjid, Mad Nor Ibrahim; Setiausaha Masjid, Osman Rasul dan AJK Masjid yang juga Ketua Umno cawangan Lenggeng, Zulkifli Rashid tidak akur dengan keputusan majoriti AJK masjid menghantar dua nama kepada Jabatan Agama Islam Negeri Sembilan (Jains).
“Kami menghantar nama Said Abdul Ghani sebagai calon Imam 1 dan Ustaz Azman Baharom sebagai calon Imam 2. Said mempunyai pengalaman sebagai Bilal selama 16 tahun dan sebagai Imam selama empat tahun.
“Walaubagaimanapun Mad Nor, Osman dan Zulkifli membelakangkan keputusan AJK Masjid dan menghantar dua nama lain iaitu Nordin Yusof dan Ali Hamzah. Nordin menolak tawaran tersebut sementara Ali pula diisytiharkan sebagai Pemangku Imam 1 oleh Mad Nor, Osman dan Zulkifli.
“Tetapi apa yang pelik sehingga hari ini tiada surat hitam putih daripada Jains yang mengesahkan pelantikan Ali sebagai Pemangku Imam 1.
Kes masih disiasat
“Saya sudah berjumpa pegawai yang berkenaan di Jains dan jawapan yang mereka berikan bahawa kes ini masih disiasat dan meminta saya bersabar,” kata Mohd Fahmy.
Apabila ditanya FMT mengapa 10 AJK Masjid termasuk Mohd Fahmy, Datuk-Datuk Undang Lenggeng dan 220 ahli kariah masjid tidak mahu menerima Ali sebagai Imam; Fahmy menjelaskan bahawa bacaan sembahyang dan tajwid oleh Ali tidak sempurna dan sering berlaku kesilapan di dalam bacaan beliau. Mohd Fahmy juga mendakwa ada tangan ghaib dan campurtangan politik di dalam kemelut ini.
“Said dituduh sebagai orang PAS. Saya dan beberapa AJK masjid merupakan ahli Umno. Bagi kami tidak penting apa fahaman politik Imam. “Ahli kariah tidak peduli apa fahaman politik Imam. Yang kami peduli ialah ilmu Imam itu mestilah mencukupi dan mampu mengendalikan bacaan sembahyang dan tajwid dengan sempurna.
“Justeru itu kami mendesak pihak Jains segera mengistiharkan keputusan panel temuduga pegawai masjid (Imam) yang diadakan pada 28 Mac 2012. Kami mendapat maklumat bahawa calon yang kami cadangkan iaitu Said dan Azman berjaya terpilih sebagai Imam”, jelas Mohd Fahmy.

Malaysia's Prime Minister Najib Razak has shelved plans for an early general election this summer after the leaking of a mountain of documents dealing with the payment of over $180 million in bribes for the purchase of two French submarines when he was defence minister.
Even more damaging for Najib, who has yet to face the electorate since taking over as leader of the stumbling Barisan Nasional coalition government in 2009, is that the documents indicate the French giant ship-builder, DCNS, paid $45 mil-lion for a classified Malaysian government document detailing its submarine requirements.
This money and the other $142 million were paid to companies controlled by Najib's friend and policy adviser, Abdul Razak Baginda.
Opposition politicians in Malaysia are claiming that, if confirmed, the sale of the classified documents which would have given the French manufacturers of the Scorpene class submarines an advantage when tendering for the $1.1-billion deal, amounts to treason.
Malaysia's current defence minister, Ahmad Zahid Hamidi, last week tried to extinguish the political fires by denying that there had been any sale or leaking of the defence department documents.
Zahid told the Malaysian parliament the submarine deal was done through "direct negotiations in accordance with procurement procedures."
And he insisted, "The minis-try has never paid any commission directly or indirectly to any companies in the procurement of the Scorpene submarines."
But that is not the allegation. The allegation is that the French company DCNS paid nearly $190 million to companies controlled by Najib's close friend Baginda.
Najib took over the government leadership after the ruling coalition, which has run the country since Malaysian independence from Britain in 1957, made a poor showing in the last elections in 2008.
He has tried to cast himself as a reformist prime minister, but his tenure so far has been rife with scandals.
In recent months there have been large hints from officials in Najib's party, the United Malays National Organization (UMNO), that he would call an early election, perhaps in July.
But last week Najib's parliamentary assistant told Parliament the government intends to hold elections only after completing its five-year mandate next March.
This Scorpene submarine story has been bubbling since 2006 with the discovery of the body of Baginda's jilted mistress, Mongolian model and translator Altantuya Shaariibuu.
She was abducted from outside Baginda's house where she had gone to demand a $500,000 cut from the bribes to keep quiet about the deal with the French in which she had acted as Bag-inda and Najib's translator.
Two of Najib's bodyguards have been convicted of Altan-tuya's murder and have been sentenced to death. They have launched appeals against the sentences.
To the surprise of many, a judge dropped murder charges against Baginda before any evidence was heard and he has been in exile in Britain since.
Najib's mounting problems with the Scorpene case came to a boil last week with the leaking of 133 files containing hundreds of pages to the Asia Sentinel online magazine, whose editor John Berthelsen has been the leading reporter on the story for several years.

The documents are part of the product of a raid on DCNS's Paris offices by the anti-organized crime unit of the French Directorate of Judicial Police in April 2010.
French officials started investigating the case the previous month at the request of a Malaysian human rights organization, Suaram, and in June 2011 presented the evidence to the prosecuting magistrate of the Court de Grande Instance in Paris, who is now considering whether to file charges.
The picture that emerges from the leaked documents, which Asia Sentinel has made avail-able on its website, is that after Najib was appointed defence minister in 1991 he embarked on a massive military modernization program.
Along with new jet fighters, tanks and coastal patrol boats he wanted submarines.
But by 1995, the French manufacturer DCNS felt it was being out-lobbied by the German company Kockums AB. DCNS decided to buy influence and after several false starts latched on to Najib's friend and policy adviser Baginda.
"The role of the latter," says one of the DCNS documents, "was to facilitate the submission procedure to the Malaysian government and the responsible ministers, in particular the minister of defence, with whom he claimed to have a close relationship."
In 2000, the equivalent of $142 million was given to a company called Perimekar, which was controlled by Baginda's wife, Mazlinda Makhzan.
In other documents, DCNS officials said they expected the money to be shared with other individuals and with the ruling party in the governing coalition, UMNO.
Another $45 million, apparently for the defence ministry's document specifying its submarine requirements, was paid to a Hong Kong-based company, Terasasi, whose principal officers are listed as Baginda and his father.
The submarines were delivered to the Malaysian navy in 2002.

KANADA 4 Julai: Satu rencana akhbar The Vancouver Sun pada 3 Julai lalu menyatakan Perdana Menteri Datuk Seri Najib Razak menangguhkan rancangan mengadakan pilihan raya umum disebabkan kes rasuah Scorpene.
Rencana ditulis Jonathan Manthorpe itu melaporkan Setiausaha Parlimen Najib memaklumkan pilihan raya hanya akan diadakan selepas tamat mandat lima tahun pada Mac 2013, walaupun sebelum ini sumber dalam Umno mengatakan ia akan diadakan Julai.
Lebih teruk bagi Najib, tulis Jonathan, dokumen siasatan polis Perancis menunjukkan firma pertahanan Perancis, DCNS membayar USD$45 juta untuk mendapatkan dokumen sulit Tentera Laut Malaysia.
“Pembangkang Malaysia berkata jika dakwaaan itu benar, penjualan dokumen sulit yang memberi kelebihan kepada DCNS dalam tender kapal selam itu adalah satu pengkhianatan.
“Masalah Najib yang bertimpa-timpa diberatkan lagi apabila 133 fail hasil serbuan Unit Anti-Jenayah Terancang Polis Kehakiman Perancis ke pejabat DCNS di Paris dibocorkan kepada laman Asia Sentinel.
“Dokumen itu antaranya menjelaskan DCNS bertindak membeli pengaruh melalui orang kanan Najib, Abdul Razak Baginda selepas merasa ketinggalan dengan syariket German, Kockums AB dalam persaingan melobi kerajaan Malaysia.
“Dalam dokumen lain, pegawai DCNS mengatakan bayaran USD142 juta kepada Perimekar akan dibahagikan kepada beberapa individu dan juga parti pemerintah iaitu UMNO,” jelas Manthorpe seperti dipetik.
7 Mei lalu, rencana Manthorpe dalam akhbar utama British Columbia itu melaporkan mahkamah Perancis memulakan perbicaraan kes Scorpene yang kini memasuki peringkat perbicaraan di Tribunal de Grande Instance, Paris.
Kes itu turut dikaitkan dengan Najib dan pembunuhan penterjemah Altantuya Sharibuu dalam skandal berkenaan.

Beberapa blog telah mendedahkan bagaimana syarikat milik anak Menteri Wilayah Persekutuan dan Kesejahteraan Bandar, Raja Nong Chik Zainal Abidin telah dianugerahkan projek kerajaan bernilai RM30.8 juta secara rundingan terus oleh Kementerian Belia dan Sukan.
Pendedahan ini sendiri tidak dinafikan Raja Nong Chik apabila berhadapan dengan media baru-baru ini.
Projek bagi membekalkan kelengkapan Institut Kemahiran Belia Negara (IKBN) Bandar Penawar Johor ini telah diberikan kepada Istijuara Sdn Bhd yang dimiliki oleh anak Raja Nong Chik, Raja Farhana binti Raja Nong Chik yang berusia 26 tahun.
Beberapa persoalan yang timbul:
a) Mengapakah projek ini diberi secara tender terbuka? Adakah Istijuara Sdn Bhd mempunyai rekod yang baik untuk projek-projek yang sama sebelum ini? Adakah Istijuara Sdn Bhd mempunyai prestasi kewangan yang baik?
b) Apakah peranan Raja Farhana, anak Raja Nong Chik di dalam projek ini? Adakah beliau menjadi wakil kepada kepentingan Raja Nong Chik di dalam Istijuara?
c) Adakah Istijuara menerima sebarang lagi projek kerajaan?
KEADILAN menyeru agar Jabatan Audit Negara memeriksa kontrak ini untuk memastikan tidak wujud sebarang salahguna kuasa di dalam penganugerahan kontrak ini. Ketua Audit Negara juga wajar mengesahkan keadaan peralatan yang dibekalkan oleh Istijuara kepada IKBN Bandar Penawar.
Jawapan Raja Nong Chik bahawa kontrak ini dianugerahkan sebelum beliau menjadi menteri tidak menjawab persoalan mengapa kontrak dimeterai pada tahun 2010 ketika beliau sudahpun menjadi menteri.
Pada masa yang sama, Raja Nong Chik boleh menjadi contoh kepada anggota kabinet yang lain dengan tampil ke hadapan bagi mengisytiharkan asetnya.
Dengan ini beliau dapat memulihkan kewibawaan imej pimpinan Umno yang mendapat projek-projek kerajaan secara terus selama ini.

PETALING JAYA: Penduduk di bawah pentadbiran Majlis Bandaraya Petaling Jaya (MBPJ) kini tidak perlu bimbang mengenai kos perkhidmatan Internet apabila kawasan tempat tinggal mereka dipilih sebagai perintis projek jalur lebar (WiFi) percuma di negeri itu.
Pada pelancarannya baru-baru ini, Datuk Bandar, Datuk Mohamad Roslan Sakiman berkata, projek itu bukan saja di kawasan Petaling Jaya, malah turut membabitkan 4,000 lokasi termasuk kawasan terpencil seluruh Selangor yang kebanyakannya didiami golongan kurang berkemampuan mendapatkan perkhidmatan internet
Beliau berkata, ia dijangka siap secara keseluruhannya pada 2015 dengan menyaksikan Taman Datuk Harun sebagai lokasi perintis bagi projek terbabit yang siap pada 29 Februari lalu.
Tinjauan Metroplus ke Taman Datuk Harun, di sini mendapati orang ramai tidak melepaskan peluang menggunakan kemudahan itu di merata tempat termasuk kedai makan.
Ia membuktikan projek terbabit mendapat sambutan menggalakkan daripada orang ramai, malah memudahkan mereka mendapatkan maklumat terkini pada bila-bila masa walau di mana mereka berada.

Mahkamah Rayuan hari ini menolak dengan kos permohonan Menteri Pertahanan Datuk Seri Ahmad Zahid Hamidi bagi membatalkan saman yang dibawa oleh seorang ahli perniagaan, yang didakwa mempunyai hubungan sulit dengan anak perempuan menteri itu.
Panel tiga hakim yang diketuai oleh Datin Paduka Zaleha Zahari sebulat suara mengekalkan keputusan Mahkamah Tinggi Shah Alam, dan mengarahkan menteri itu untuk membayar RM5,000 sebagai kos.
Ahli-ahli panel yang lain ialah Hakim Datuk Clement Allan Skinner dan Datuk Aziah Ali.

Mahkamah Rayuan hari ini menolak dengan kos permohonan Menteri Pertahanan Datuk Seri Ahmad Zahid Hamidi bagi membatalkan saman yang dibawa oleh seorang ahli perniagaan, yang didakwa mempunyai hubungan sulit dengan anak perempuan menteri itu.
Panel tiga hakim yang diketuai oleh Datin Paduka Zaleha Zahari sebulat suara mengekalkan keputusan Mahkamah Tinggi Shah Alam, dan mengarahkan menteri itu untuk membayar RM5,000 sebagai kos.
Ahli-ahli panel yang lain ialah Hakim Datuk Clement Allan Skinner dan Datuk Aziah Ali.

Berkuatkuasa serta merta, Akuan Berkanun akan digunakan untuk urusan tukar milik kenderaan di Jabatan Pengangkutan Jalan (JPJ) bagi menggantikan penggunaan Mykad yang disahkan oleh Pesuruhjaya Sumpah sebelum ini.
Menteri Pengangkutan Datuk Seri Kong Cho Ha berkata keputusan itu diambil selepas perbincangan lanjut diadakan antara JPJ dan Pejabat Pendaftar Mahkamah Persekutuan dengan mengambil kira maklum balas yang diterima daripada pemilik kenderaan dan pengusaha-pengusaha kenderaan terpakai.
"Pemunya berdaftar dan pemunya baru kenderaan perlu mengisi borang akuan sebelum tukar milik kenderaan dilakukan dan kemudiannya disahkan oleh Pesuruhjaya Sumpah yang dilantik oleh Mahkamah Persekutuan," katanya dalam kenyataan hari ini.
Kong berkata borang itu boleh dimuat turun melalui portal JPJ di alamat www.jpj.gov.my.
Penggunaan Akuan Berkanun adalah seperti yang diperuntukkan mengikut Akta Akuan Berkanun 1960 iaitu sesiapa yang didapati membuat pengakuan palsu boleh diambil tindakan perundangan menurut akta ini.

Malaysian court clears Anwar Ibrahim of sodomy charges : NATION News - India Today
When the Kuala Lumpur High Court judge delivered a not guilty verdict in the Anwar Ibrahim sodomy trial, the former deputy prime minister was taken aback. Ibrahim, 64, told reporters after his release on January 9, "To be honest, I am a little surprised." The final scene of the 13-year politico-legal drama was over faster than anyone expected. Judge Zabidin Mohamad Diah took only two minutes to give his ruling, saying DNA samples used as evidence might have been contaminated and that he could not convict in the absence of other corroborating evidence.
The judgment has brought the curtains down on one of the most controversial chapters in Malaysian political history. Ibrahim has been on trial for sodomy twice and has always maintained that the charges were politically motivated. He was deputy prime minister between 1993 and 1998. Ibrahim was booted out of the government in 1998 for challenging the authority of then prime minister Mahathir Mohamad. In 1999, Ibrahim was sentenced to six years in prison for corruption, and in 2000, to another nine years on charges of sodomy. The court reversed the second sentence in 2004, paving the way for his release. In July 2008, he was arrested again on sodomy charges, just after he had led a three-party Opposition coalition to unexpected success in the elections.
Ibrahim has gone on to become a symbol for change in not just Malaysia but across the region. He brought the Opposition together, posing a challenge to the ruling National Front.
So what does the verdict mean for Malaysia? Has the victory given Ibrahim an edge over his fiercest critic and rival, Prime Minister Najib Razak? Professor James Chin at Monash University in Malaysia believes the acquittal does not really do much for Ibrahim. He says, "The sodomy issue would have been more effective had Anwar been found guilty. But now it is unlikely to be a major campaign issue." Political analyst Ooi Kee Beng explains, "One of the biggest challenges for the Pakatan Rakyat (the three-party Opposition coalition) is to convince voters that it has the leaders needed for a change in paradigm."
Other Malaysian political analysts see the verdict as a sign that the judiciary in Malaysia is really independent. They say it disproves Ibrahim's claims about government interference in the judiciary, especially since Judge Diah had earlier come under fire from his counsel for being biased.
Ibrahim's camp, led by stalwarts including Azmin Ali, deputy president of his party, Parti Keadilan Rakyat, is thrilled with the acquittal. "This is not justice for Ibrahim alone, but for all those who care about freedom and justice," says Ali. He adds, "We will continue to explain to people that Ibrahim is a victim of a malicious conspiracy." But Ali is also quick to counter claims about the judiciary's independence. He says that is a claim made by Razak and Mahathir. The deputy chief of the Keadilan party says public perception is very different. "Malaysians feel there is a need for reform in the judicial system, and there are very few judges left who speak from their conscience," he claims.
So how does the verdict change the face of Malaysian politics? Both sides have different views on its impact. Azmi Anshar, chief editor of one of Malaysia's most prominent dailies, The New Straits Times, believes this will finally end Ibrahim's "unfair advantage" over his rivals. Says Anshar, "In the past 42 months, since the accusations against Ibrahim were first made, he has used the court solely as a political campaign platform. Now he can no longer use court for political sermons and that will even out the playing field." He believes, "Ibrahim will use his freedom to claim that the government tried to fix him, and that his victory was just a fluke."
The impact of this verdict will most certainly be seen in the forthcoming polls, as Razak tries to hold on to power and Ibrahim's attempts to improve upon his three-party coalition's 2008 success. Elections in Malaysia could be held anytime between June 2012 and March 2013, say analysts.
Cleared of the sodomy charge, Ibrahim is all set to hit the campaign trail. He will use the verdict to galvanise the Opposition. "We are ready for any eventuality; we have been ready for elections for over a year now. The verdict has given us confidence that we can capture Putrajaya (the federal administrative centre of Malaysia)," says Ali.
Anshar believes Razak has an edge. He says, "Either a status quo will be maintained or the government will scrape through. But it will be wrong to underestimate the popularity of Razak, who managed to draw in the support of many disgruntled voters during his last campaign."
Now that he is a free man, unless the Government appeals, Ibrahim seems to be even more determined to ensure that his three-party Opposition coalition is a force to reckon with in Malaysian politics. This was foremost on his mind as he walked out of the court on January 9. He tweeted moments after the judgment, "In the coming elections, the voice of the people will be heard, and this corrupt government will be toppled from its pedestal of power."

NEW DELHI: Rebels shot dead five people at a polling station in India's northeast on Saturday as voting began in the first of five local elections seen as a popularity test for the national Congress government.
The separatist rebels sprayed the voting booth with bullets, killing three election officials, a paramilitary trooper and a civilian in Thangpi, a village south of Manipur state capital Imphal, police chief Priya Singh said.
"The militants opened random fire," Singh told AFP, adding two other people were hurt in the attack which came despite tens of thousands of security forces deployed in a bid to thwart attacks during the voting for a new assembly.
The rebels who staged the attack on the crowded polling booth in far-flung Manipur were believed to be from the National Socialist Council of Nagaland, Singh said, but added no group had claimed responsibility.
The voting in Manipur was the first of five assembly elections viewed as a mini-referendum for Premier Manmohan Singh's embattled Congress coalition which is at the centre of a storm of corruption and mismanagement scandals.
National polls are due in 2014.
Tensions were already elevated in impoverished Manipur after five explosions in the run-up to the polls killed two people, along with rebel calls for a boycott of the election, police said.
India's northeast has been wracked by deadly separatist insurgencies since the country's independence in 1947. At least 30 ethnic rebel groups are active in highly militarised Manipur, a state of just 2.7 million people.
The voting in the states of Manipur, Uttar Pradesh, Uttarakhand, Punjab and Goa is being staggered through February and early March with the results to be announced in early March.
While regional issues will weigh heavily in the five elections, the polls are putting to the test not only the standing of Congress but also of 41-year-old Rahul Gandhi, tipped as a future prime minister.
Gandhi, scion of the Nehru-Gandhi political dynasty that has dominated India for most of its post-independence history, has taken centre stage during campaigning for the elections.
Next weekend's elections take place in caste-riven Uttar Pradesh which traditionally influences the formation of the national government and where Gandhi has been focusing his campaigning energies.
The pivotal state of 200 million people, governed by the mercurial chief minister Mayawati -- known as India's "Dalit Queen" -- will send 80 members to the 552-seat parliament in the next national elections in 2014.
Mayawati, who comes from an "untouchable" or Dalit community on the bottom of India's caste hierarchy, has built up a reputation as a populist leader who taps into massive support among low-caste Indians, who are often marginalised.
Congress is not tipped to win in Uttar Pradesh, but if the bachelor Gandhi can improve on his party's woeful performance in the last elections in 2007, he can look forward to a shot of "political Viagra," said analyst Uday Bhaskar.
But the party is expected by some commentators to regain power in the key agricultural heartland of Punjab and the mountainous state of Uttarakhand.
Congress is also seen as virtually certain to extend its rule in Manipur after winning all but one election there since 1984.
The fifth region in play is Goa, the coastal resort where Congress has long been dominant and where it is currently holds power in a coalition.

1. Bila PM Najib dimaklumkan oleh Ahmad Said sebelum secara "tiba-tiba" rakyat dikejutkan tentang penamatan perkhidmatan?
2. KPN Musa yang walaupun menghadapi masalah serangan jantungpun masih meneruskan tugas dan sambung kontrak lagi baru-baru ini? Mungkin belum ada yang berwibawa dan boleh diharapkan untuk jaga kepentingan UMNO dan BN.

SEREMBAN: Datuk Seri Najib Tun Razak berkata penamatan lebih awal kontrak perkhidmatan Ketua Pesuruhjaya Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) Datuk Seri Ahmad Said Hamdan tidak berlaku secara tiba-tiba kerana beliau (Najib) sudah dimaklumkan lebih awal lagi.
Perdana Menteri berkata beliau sudah dimaklumkan dahulu tetapi orang ramai hanya mengetahui peletakan jawatan Ahmad Said baru-baru ini.
"Bukan sudden, dia sudah beritahu lebih awal lagi sebenarnya, ini cuma the question of public knowledge sebenarnya tetapi saya dah tahu lebih awal lagi sebelum isu terkini berbangkit," katanya kepada pemberita selepas menyampaikan hadiah kepada juara Kejohanan Badminton sempena Program Tahunan Isteri Wakil-wakil Rakyat Barisan Nasional (BN) di sini semalam.
Najib juga menolak tanggapan kononnya peletakan jawatan Ahmad Said mempunyai kaitan dengan tekanan pembangkang berikutan kes kematian Teoh Beng Hock, setiausaha politik kepada anggota Exco kerajaan negeri Selangor.
Persaraan Ahmad Said juga tidak ada kaitan dengan tanggapan kononnya tekanan telah diberikan oleh pihak kerajaan untuk beliau berhenti, katanya.
"Kerajaan menghormati keputusan Ahmad Said untuk bersara, sebenarnya dia sudah pun bersara tetapi berkhidmat dalam kontrak, cuma dia tidak berkhidmat sampai kontraknya habis," katanya lagi.
Beliau turut mengucapkan terima kasih kepada Ahmad Said di atas bakti yang dicurahkan selama beliau berkhidmat dengan SPRM.

Faktor untuk meluangkan masa bersama keluarga menjadi alasan utama beliau menamatkan lebih awal kontraknya yang sepatutnya berakhir pada Mei tahun depan.

SEREMBAN: Datuk Seri Najib Tun Razak berkata penamatan lebih awal kontrak perkhidmatan Ketua Pesuruhjaya Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) Datuk Seri Ahmad Said Hamdan tidak berlaku secara tiba-tiba kerana beliau (Najib) sudah dimaklumkan lebih awal lagi.
Perdana Menteri berkata beliau sudah dimaklumkan dahulu tetapi orang ramai hanya mengetahui peletakan jawatan Ahmad Said baru-baru ini.
"Bukan sudden, dia sudah beritahu lebih awal lagi sebenarnya, ini cuma the question of public knowledge sebenarnya tetapi saya dah tahu lebih awal lagi sebelum isu terkini berbangkit," katanya kepada pemberita selepas menyampaikan hadiah kepada juara Kejohanan Badminton sempena Program Tahunan Isteri Wakil-wakil Rakyat Barisan Nasional (BN) di sini semalam.
Najib juga menolak tanggapan kononnya peletakan jawatan Ahmad Said mempunyai kaitan dengan tekanan pembangkang berikutan kes kematian Teoh Beng Hock, setiausaha politik kepada anggota Exco kerajaan negeri Selangor.
Persaraan Ahmad Said juga tidak ada kaitan dengan tanggapan kononnya tekanan telah diberikan oleh pihak kerajaan untuk beliau berhenti, katanya.
"Kerajaan menghormati keputusan Ahmad Said untuk bersara, sebenarnya dia sudah pun bersara tetapi berkhidmat dalam kontrak, cuma dia tidak berkhidmat sampai kontraknya habis," katanya lagi.
Beliau turut mengucapkan terima kasih kepada Ahmad Said di atas bakti yang dicurahkan selama beliau berkhidmat dengan SPRM.

BUKIT MERTAJAM: Pilihan raya kecil Dewan Undangan Negeri (DUN) Penanti yang menyaksikan pertandingan empat penjuru mencatatkan rekod pilihan raya kecil paling aman tanpa insiden buruk.Ketua Polis Negeri, Datuk Ayub Yaakob, berkata tiada kejadian buruk berlaku sepanjang proses pengundian berjalan dari jam 8 pagi hingga jam 5 petang semalam.
"Keadaan aman dan terkawal dan ini adalah pilihan raya kecil paling aman," katanya kepada pemberita di pusat penjumlahan undi di Institut Kemahiran Belia Negara (IKBN) di sini, semalam.
Sementara itu, kemudahan yang disediakan Suruhanjaya Pilihan Raya (SPR) termasuk kerusi roda, petugas dan kelengkapan barong semakan pendaftaran pengundi, menjadikan pilihan raya kecil itu sebagai mesra pengundi.
Kehadiran ramai anggota polis yang mengawal kawasan berhampiran sekolah yang diwarta sebagai pusat pengundian, selain mengawal lalu lintas juga mewujudkan keyakinan dan keamanan kepada pengundi.

Political turmoil wracks northern state in Malaysia

In the latest twist in a protracted power struggle in the northern Malaysian state of Perak, a High Court judge ruled on May 11 that former Chief Minister Nizar Jamaluddin had been unconstitutionally removed from office and ordered his reinstatement. The following day, the appeals court issued a stay on the High Court decision pending a challenge by the Barisan Nasional (BN) coalition and Nizar was again removed from office.
Nizar is a member of the Islamist Parti Islam se-Malaysia (PAS), which along with the People’s Justice Party (PKR) led by opposition leader Anwar Ibrahim and the ethnic-Chinese Democratic Action Party (DAP) form the People’s Alliance (PR). The main component of the BN coalition is the United Malay National Organisation (UMNO), which has held power at the national level since independence in 1957.
The political crisis in Perak stems from the major setbacks suffered by BN in Malaysia’s national elections in March 2008. BN lost its two-thirds majority in federal parliament and control of five of the country’s states to the PR coalition, including Perak. The losses forced Prime Minister Abdullah Badawi to announce later last year that he would step down as UMNO leader.
The turmoil in Perak erupted this January when UMNO assemblyman Nasarudin Hashim switched sides and joined Anwar’s PKR. The announcement shocked UMNO leaders who had been fending off attempts by Anwar to encourage others at the state and federal level to defect. It was also a blow to then Deputy Prime Minister Najib Razak, who was chief of UMNO’s Perak chapter and due to take over as prime minister in March.
Within days, two PKR assemblymen—Jamaluddin Radzi and Osman Jailu—disappeared only to surface sometime later to declare themselves “independents” but “friendly” to the BN coalition. Deputy speaker Hee Yit Foong, a member of DAP, declared herself to be “independent” shortly after. She was followed by Nasarudin Hashim who switched back to UMNO, barely two weeks after declaring his allegiance to the PKR.
The four defections were enough to undermine PR’s majority in the state assembly. In response, Nizar formally asked the head of state, Sultan Shah, to dissolve the assembly and hold new elections, confident that the defectors would be defeated at the poll. The sultan, however, sided with BN, ruling that it could form a new state government.
These sordid political manoeuvres, in which prime minister-designate Najib had a major role, resulted in a march of 3,000 people to protest the sultan’s decision on February 6. Police broke up the march. Counter demonstrations by UMNO supporters stirred up ethnic Malay communalism and denounced plans by DAP chairperson Karpal Singh to challenge the sultan’s decision as unconstitutional.
A by-election in the federal Perak seat of Bukit Gantang in April quickly became a referendum on the ouster of the PR state government and the role of Najib. PAS fielded former Chief Minister Nizar as its candidate. UMNO responded by running a vicious communal campaign branding Nizar as a “Chinese stooge”. Ethnic Chinese comprise about 30 percent of Malaysia’s population.
UMNO attacked a state government measure passed last December allowing 149,000 people living in 483 planned and new villages to apply for freehold titles. Many of the villagers were ethnic Chinese who were relocated during the insurgency led by the Stalinist Malaysian Communist Party (MCP) in the 1950s. The land allocation, pushed by the DAP, was directly opposed by Najib who sought to maintain federal authority over land questions.
The results of the by-election, which Nizar won easily, came as a blow to Najib who had been installed as prime minister just two days earlier. Two other by-elections took place on the same day—BN won a state assembly seat in Sarawak but lost the state assembly seat of Bukit Selambau to the PKR in Kedah.
This week’s initial High Court decision was another blow to the prime minister. Judge Abdul Rajim, citing Article 16 Paragraph 6 of the Perak constitution, ruled that only the state assembly through a “vote of no confidence” had the power to dismiss a sitting state chief minister. As that had not taken place in February, Nizar remained “chief minister at all material times”.
The court system in Malaysia is notorious for its partisan decisions in favour of UMNO. As a result, the High Court ruling came as something of a surprise, indicating deep-seated divisions within the state apparatus over UMNO’s continued rule.
UMNO has maintained itself in power for more than half a century through a combination of Malay communal politics, police-state measures and economic policies that have benefitted a thin layer of the ethnic Malay elite. Sections of business, however, have come to regard UMNO’s policies as a barrier to foreign investment. Opposition leader Anwar Ibrahim was expelled from UMNO and convicted on trumped-up charges in 1998 primarily because of his advocacy of the IMF’s free market agenda in the midst of the Asian financial crisis.
The deepening global recession that has hit the country’s export-oriented industries hard is exacerbating the divisions in Malaysian ruling circles. Differences over economic policies are being compounded by growing fears in the ruling elite of an eruption of social unrest due to rising unemployment and poverty. Neither coalition—the BN and the opposition PR—represent the interests of working people.
The Centre for Public Policy Studies in 2008 reported that Malaysia had the highest Gini Coefficient in Asia. The Gini Coefficient is a standard measure of social inequality—0 denotes total equality and 1 denotes total inequality. Malaysia’s coefficient stood at 0.46.
According to the 2008 Forbes wealth report, the 40 richest Malaysians had amassed a total of $46 billion, equivalent to more than 21 percent of the 2008 GDP. Among the richest was Najib’s younger brother, chief executive officer of Bumiputra Holdings Company, worth $100 million, and the son of former Prime Minister Mahathir Mohammed with $285 million.
Official estimates of poverty are low. According to ALIRAN, a Malaysian human rights organisation, the official poverty line is well below the actual cost of living in Malaysia. ALIRAN estimated the real level of poverty at over 25 percent of the population in 2004.
The Malaysian economy is rapidly heading for recession. Exports fell for the fifth consecutive month in February, dropping 15.9 percent year-on-year after plunging 27.8 percent year-on-year in January. A UN think tank has predicted zero growth for the economy in 2009. The Malaysian Insider reported that 26,000 workers have been laid off since October 2008, with total job losses expected to reach 40,000 by May.
The government is attempting to make the country’s estimated 3.5 million foreign workers—legal and so-called illegal residents from Indonesia, the Philippines, India and Burma—the scapegoat for the worsening social crisis. The contracts for 300,000 foreign workers have not been renewed. The government has announced plans in parliament to reduce the number of foreign workers by more than 400,000 by 2010.
In office for just over a month, Prime Minister Najib has attempted to undermine Anwar and the opposition by promising a series of “reforms” to encourage foreign investment, including possible changes to discriminatory policies against the country’s Chinese and Indian minorities. Such measures, however, will inevitably create divisions within UMNO that has always relied heavily on Malay communalism. Moreover, UMNO’s loss of two out of three by-elections last month, indicate that the BN government remains broadly unpopular despite the change of prime minister.
Within this context, the ongoing political crisis in Perak, as an indication of broader trends, demonstrates that UMNO’s protracted hold on power is slipping.

Notes of decision in Zambry v Nizar Case (CoA)

MAY 23 — These are the notes taken of the Court of Appeal’s Decision in the MB v MB matter delivered orally on 22.5.2009 by Raus Sharif JCA on behalf of the His Lordship, Zainun Ali JCA and Ahmad Maarop JCA.
Any mistakes herein are mine.
Firstly, we would like to thank counsel in assisting us to arrive at our decision. The decision is unanimous and these are our views:
1. The granting or withholding of consent to dissolve the State Assembly is a royal prerogative to be exercised by His Royal Highness (HRH).
2. From the facts of this case, the request made by the Respondent (Nizar) to dissolve the State Assembly was made under Article 16(6) of the Perak Constitution, and not under Article 36(2).
3. Under Article 16(6) of the Perak Constitution, upon the exercise of HRH’s royal prerogative to withhold consent for dissolution, the Respondent shall tender his resignation.
4. There is no mandatory, express requirement that provides for a motion of no-confidence to be passed in the State Assembly against the Respondent before he ceases to command the confidence of the majority.
5. The fact that the Respondent has ceased to command the confidence of the majority may be ascertained through extraneous means. We approve the case of Amir Kahar. The case of Stephen Kalong Ningkan, adopted by the learned Judge (High Court), is distinguishable on its facts.
6. HRH was right to make enquiries to satisfy himself whether the Respondent had ceased to command the confidence of the majority before deciding on the Respondent’s request for dissolution.
7. On the facts of the case, it is clear that the Respondent had ceased to command the confidence of the majority thus HRH, in accordance with Article 16(6), was right to appoint the Appellant (Zambry) as Mentri Besar of Perak after being satisfied that the Appellant commanded the confidence of the majority.
8. The learned Judge (High Court) erred in law when interpreting the Perak Constitution. He failed to properly appreciate the evidence rendering his decision clearly wrong.
9. The appeal is allowed. The orders of the High Court are set aside.

Raus Sharif JCA: I have tried to prepare the full grounds last night but could not do so. Will supply in a week's time. What about the application to set aside the stay?
Haji Sulaiman: We leave it to the Court to decide.
Raus Sharif JCA: Isn't it academic already?
Haji Sulaiman: We are of the view that the Court of Appeal was wrong to grant the stay. To say that we concede is not entirely correct but it has served no purpose anymore. We therefore leave it to Your Lordships and Ladyship to decide. Alternatively, for a Court to to fix a hearing date.
Cecil Abraham: We seek that the application be dismissed.
